MAJOR ACHIEVEMENTS:

We represented the Kenya National Highways Authority in various suits arising from the construction of the Southern By-Pass, a major road infrastructure project that decongests the City of Nairobi by channeling vehicular traffic off the CBD onto the main A1 highway through Kikuyu Town. We successfully represented the Authority in more than 10 suits in which the claimants sought to enforce alleged proprietary rights to various parcels of land valued in excess of Kshs.3 billion against the Authority’s rights to construct the highway on the parcels that had been previously compulsorily acquired and reserved for the road by the Government of Kenya

We have represented clients in major arbitration and adjudication processes arising from major construction works. In particular, we have represented Kenya National Highways Authority in two major arbitrations. The first being the Kshs.500 million World Bank funded project to rehabilitate infrastructure affected the 2008 post-election violence and the second one involving a Kshs.850 million claim by a contractor in respect of a dispute over the construction of the Bondo-Kisian Road.

We represented Baseline Architects Limited in arbitration proceedings against the National Hospital Fund arising from the implementation of the Fund’s Specialized Medical Centre at Karen. The client was awarded the sum of Kshs.2.7 billion in outstanding fees and interests.

We have represented the Kenya National Highways Authority and the China Roads and Bridges Corporation in a major dispute arising from the construction of the Standard Gauge Railway. In this matter we successfully asserted, in the High Court of Kenya sitting at Mombasa, that the public right to construct the railway and the attendant infrastructure outweighed private property interest.

 

Through Ministry of Tourism and the Tourism Fund, drafted the Kenya Finance Institutions Bill and the Tourism Bill both of which have been enacted by Parliament

We were retained by a Senator to draft the Preservation of Human Dignity and Access to Economic and Social Rights Bill to be presented before the Senate as a private members Bill. This Bill is to give effect to Article 28 of the Constitution of Kenya.

We were retained by the Independent Medico-Legal Unit (IMLU-Kenya) and the Parliamentary Human Rights Caucus to draft the Coroners Services Bill which Bill is pending debate before the Parliament.

We retained by the National Council for Population and Development to draft the National Council for Population and Development Bill, 2016. The Bill is pending action in Parliament.
